■Overview

There is a growing interest in independent living of persons with disabilities in the community in light of the infections of COVID-19 and deaths caused by it, particularly in congregate living arrangements. This is reflected in the on-going work of the UN Committee on the Rights of Persons with Disabilities on the “Living independently and being included in the community: Guidelines on deinstitutionalization of persons with disabilities, including in emergency situations”, expected to be finalized in 2022.

In East Asia as well, we have the challenges of implementation of article 19 of the Convention on the Rights of Persons with Disabilities, “Living independently and being included in the community”. One example is Japan, where more than half a million people are institutionalized in mental hospitals and residential institutions. In 2016, 19 persons with intellectual disabilities were knifed to death at a residential institution, that highlighted the issues of institutionalization. Some survivors, as a silver lining of this huge tragedy, have moved to the community with personal assistance.

Regarding article 19, China, Korea, and Taiwan (not a U.N. member but has domesticated the CRPD and organized its own international review) all received recommendations to promote the independent living of persons with disabilities in the community. This reflects the reality in East Asia, where both (a) issues of institutionalizations and (b) challenges of achieving independent living, meaning choice and control by persons with disabilities, need to be addressed.

This Forum explores the promotion of independent living of persons with disabilities in the community in the context of East Asia.


開催趣旨

新型コロナウイルス感染症の世界的流行は、特に集合的生活環境における感染拡大と、多くの入所者の死亡をもたらした。そのために改めて、障害者の地域での自立生活への国際的関心が高まっている。それは具体的には、障害者権利委員会によって現在進められている「脱施設化のガイドライン」策定作業(2022年に採択予定)にも示されている。

本セミナーが対象とする東アジアにおいても、障害者権利条約第19条が求める「障害者の地域での自立生活」実施の課題は引き続き大きい。たとえば約50万人の障害者が入院(多くが精神科病院)、入所している日本においても、2016年に19名の知的障害者が知的障害者入所施設で殺害された事件、そして一部の被害者のパーソナルアシスタンスの利用による地域生活への移行によって地域での自立生活の課題と可能性が示されている。

そして「自立した生活及び地域社会への包容」に関する障害者権利条約第19条に関して中国、韓国、台湾(国連加盟国ではないが、同条約を国内法化し、独自の国際審査を実施済み)全てに対して障害者の地域での自立生活の実現を促す勧告が出されている。それは入所や入院の問題だけでなく、在宅で家族に依存せざるを得ず、障害者が選択権と自己決定権を持つことを意味する自立生活が達成されていない東アジアの現状を示している。

本セミナーでは、多くの共通点を持つ東アジアにおける、病院や入所施設から地域での自立生活への移行の道筋を探る。

Shinichiro Kumagaya, M.D., Ph.D. is an associate professor at Research Center for Advanced Science and Technology, The University of Tokyo, Japan. He received M.D. from the University of Tokyo in 2001. From 2001 to 2002, he was a pediatric resident at The University of Tokyo Hospital. From 2002 to 2004, he was a general pediatrician at Chiba-Nishi General Hospital. From 2004 to 2005, he was a pediatric cardiologist at Saitama Medical University Hospital. In 2009, he joined the University of Tokyo. His research interests include Tojisha-Kenkyu, pediatrics, developmental sciences and disability studies.

Based on his own 10 years experiences as a pediatrician with physical disabilities called cerebral palsy, he has been trying to change medicine and human sciences into something more inclusive by having persons with disabilities or illnesses, who have traditionally been just objects of medicine or research, become researchers since he joined UTokyo as a faculty member in 2009. These issues are becoming an internationally important topic, with emphasis on ‘co-production of research.’ he has been committed to studying the history, philosophy, theory, and methodology of participatory research called 'tojisha-kenkyu' in Japanese, which was an unique grass-rooted participatory research born in Japan back in 2001, and sharing those practices and applying them to research on autism spectrum disorders since 2008. In October 2018, he implemented a user-researcher system in collaboration with the Human Resources Department for University of Tokyo to advance participatory research in Japan and employed five people with disabilities. In addition, as a university-wide initiative, he has been in charge of the Director of Disability Services Office since April 2017 and provided reasonable accommodation in cooperation with various departments on campus to achieve equal access to education and research activities for students, faculty, and researchers with disabilities. In particular, to strengthen inclusiveness in the field of STEM, which is a major issue around the world, he launched Inclusive Academia Project.

熊谷晋一郎(M.D.、Ph.D.)、東京大学先端科学技術研究センター准教授。2001年に東京大学より医学博士号を取得。2001年から2002年にかけて、東京大学医学部附属病院の小児科レジデントとして勤務。2002年から2004年にかけて、千葉西総合病院の一般小児科医として勤務。2004年から2005年にかけて、埼玉医科大学病院の小児循環器専門医として勤務。2009年、東京大学に着任。研究領域は当事者研究、小児科学、発達科学、障害学など。

2009年に東京大学に教員として着任して以来、自身が脳性麻痺という身体障害をもつ小児科医としての10年間の経験をもとに、従来は医療や研究の対象でしかなかった障害や病気をもつ人たちを研究者にすることで、医療や人間科学をよりインクルーシブなものに変えていこうとしている。このような問題は、「研究の共同創造」に重点を置いた国際的に重要なテーマとなっている。彼は、2001年に日本で生まれたユニークな草の根の参加型研究である「当事者研究」の歴史、哲学、理論、方法論を研究し、その実践を共有し、2008年から自閉症スペクトラムの研究に応用することに尽力してきた。2018年10月には、日本の参加型研究を進めるために、東京大学人事部と共同でユーザー・リサーチャー制度を導入し、5名の障害者を雇用した。また、全学的な取り組みとして、2017年4月からバリアフリー支援室室長を担当し、障害のある学生・教員・研究者の教育・研究活動への平等なアクセスを実現するために、学内各部局と連携して合理的な配慮を行ってきた。特に、世界的に大きな課題となっているSTEM分野でのインクルーシブ化を強化するため、インクルーシブ・アカデミア・プロジェクトを立ち上げた。

Kim Kyung-Mee, Ph.D., is professor in the Department of Social Welfare at Soongsil University in Seoul and the president of Korean Society for Disability Studies. Her career as an academician in the area of disability studies span over 30 years. Her research focuses on independent living, personal assistance services for people with disabilities, women with disabilities, disability discrimination law, diverse population with disabilities, aging with disabilities, and digital divide, future planning for people with intellectual and developmental disabilities, and self-direction.

Introduction: Min Lei, M.A. in Sociology, Ph.D. candidate at Wuhan University School of Law. Her research interests include sociology of law, human rights law, and children's rights. Her master's thesis is titled "The Influence of Significant Others on the College Education Expectation of Rural Left-behind Children", which analyzes the effects of parent-child connection, peer connection, teacher-student connection and resilience on the college education expectations of rural left-behind children through Amos model. She participated in the National Social Science Project and co-authored the article "Value Orientation and Practice Progression of Social Work Innovation and Development" in Learning and Practice (CSSCI) No. 10, 2018. 2018, the paper Task-centred Practice in Social Work won the first prize of the 10th China Social Work Student Forum and the 3rd MSW Graduate Student Forum.
简介:闵蕾,社会学硕士,武汉大学法学院博士研究生。研究方向为法社会学、人权法、儿童权利。硕士论文题目为《重要他人对农村留守儿童大学教育期望的影响路径研究》,通过Amos模型分析亲子联系、朋辈联系、师生联系和抗逆力对农村留守儿童大学教育期望的影响效果。参与国家社科项目并合作发表《社会工作创新发展的价值取向与实践进路》一文于《学习与实践》(CSSCI)2018年第10期。2018年,论文Task-centred Practice in Social Work获第十届中国社会工作大学生论坛暨第三届MSW研究生论坛一等奖。

Lin Chun-Chieh had been denied for her education rights and lived in a medicalized institution for eight months when she was a child. Later, she received a law degree from National Taipei University, and then involved in independent living (IL) training of the Duskin Leadership Training Program in Japan in 2005. She was one of main founders of Taiwan IL Center and an activist of IL and PA availability for disabled people in Taiwan since 2006.

I was born in Osaka in 1960. I have had cerebral palsy since I was a child, and after spending time at a special school and a residential institution, went on to a regular junior and senior high schools. I have been involved in the disability rights movement since I entered Osaka City University in 1978. I was involved in the campaign to enact the nation's first barrier-free ordinance in Osaka Prefecture, and then founded the Navi Center for Independent Living to support the independent living to support my peers. In the Diet (parliament), I made testimonies on the disability services legislation and the in 2005 and 2006, and on the CRPD ratification in 2013. I also served as the Secretary General of Japan National Assembly of Disabled Peoples' International (DPI Japan), and a member of the Council for the Promotion of Systemic Reform for Persons with Disabilities, and a member of the Disability Policy Committee. Currently, I am the Vice Chairperson of DPI Japan and an advisor to the Cabinet Office on policies for persons with disabilities.
1960 年大阪に生まれる。子どもの時から脳性マヒの障害があり、養護学校、施設で過ごした後、普通中学・高校へ進む。1978年大阪市立大学入学直後から障害者運動に関わり始める。全国初となった大阪府バリアフリー条例制定運動に携わった後、自立生活センター・ナビを立ち上げ仲間の自立生活支援を進める。2005、06年の国会で障害者自立支援法、2013年臨時国会で障害者権利条約批准に関する参考人として意見陳述。DPI日本会議事務局長、障害者制度改革推進会議委員、障害者政策委員会委員等を歴任。現在、DPI日本会議副議長、内閣府障害者施策アドバイザー。

Jo Han-Jin, Ph.D., is professor in the Department of Disability Studies of Graduate School and director of the Institute for Disability Studies at Daegu University. He studied social work and disability studies at Soongsil University and University of Illinois. Zhang Wanhong earned his Ph.D. in Law from Wuhan University School of Law, where he now holds the position of Professor of Jurisprudence. He is the Director of Wuhan University Public Interest and Development Law Institute. And he is one of the founders and the Executive Director of Wuhan University Institute for Human Rights Studies. He is the pioneer of disability rights studies and movement in China. He is the editor-in-chief of Disability Rights Studies in China.
法学博士,武汉大学法学院教授,博士生导师,兼任湖北省残疾人联合会副理事长,武汉大学人权研究院执行院长,武汉大学公益与发展法律研究中心主任,中国残疾人事业发展研究会权益保障专业委员会主任,湖北省残疾人事业发展研究会副会长。张万洪教授多年来积极进行残障领域的研究和倡导工作,承担多项国家级的残障研究课题,在残障领域著述颇丰,主编《残障权利研究》集刊。

As a father of a girl with autistic disability, Feng Dong started to engage in the support work to other families with autistic disabilities since 2011. He was one of founders who established Ningbo Xingbao Family Support Center for Persons with Autistic Impairments. He joined the Inclusion Network of Parents Organizations since 2018 and became the committee executive director in 2021. He commits to promote the inclusive education and independent living in the communities for persons with intellectual and developmental disabilities.
2011年起开展自闭症群体的帮扶工作,发起并创立宁波市星宝自闭症家庭支援中心(简称“中心”);2017年辞去公职,担任中心主任;2018年,加入“融合中国”家长组织网络;2019年,担任中心理事长;2021年,担任北京市晓更助残基金会“融合中国”项目管理委员会主任委员。

Hung Hsin-Ping got master degree at State University of New York at Buffalo for Sociology, then studied at National Chengchi University graduate Institute for Interdisciplinary Legal Studies. She is quite interested in long-term care services development, the Convention on the Rights of Persons with Disabilities (CRPD) studies, and People with Disabilities Rights advocacy. She has been working with several NPOs related to disability rights and gender equality since 2004. Now, she serves as Secretary General of The league For Persons With Disabilities Taiwan.

Kim Won-Young is a writer, lawyer, and performer. He is currently a Ph.D candidate in law at Seoul National University College of Law. Matsubara Yoko (松原洋子)is Vice President and Professor of the Graduate School of Core Ethics and Frontier Sciences at the Ritsumeikan University, Kyoto, Japan. She earned her Ph.D. from Ochanomizu University in 1998. Her research interests include the history of eugenics and the bioethics of reproductive technologies, as well as improving the accessibility of university libraries by digitizing books for students with print disabilities.
立命館大学副学長・立命館大学大学院先端総合学術研究科教授。1998年お茶の水女子大学大学院人間文化研究科修了。博士(学術)。主な研究テーマは、優生学の歴史および生殖技術の生命倫理。読書に障害をもつ学生の支援のため、図書のデジタル化による大学図書館のアクセシビリティ向上の研究にも取り組んだ。

Chen Bo is currently an assistant professor at the Faculty of Law, Macau University of Science and Technology, and also an adjunct lecturer at the Centre for Disability Law and Policy, National University of Ireland Galway. Chen Bo holds a PhD in law from NUI Galway. Before that, he worked with a China-based public interest law institute that advocates for the rights of persons with mental health issues. His research interests include China’s mental health and capacity law, disability law, and the UN Convention on the Rights of Persons with Disabilities.
陈博,法学博士,澳门科技大学法学院助理教授,爱尔兰国立大学(高威)残障法律与政策研究中心兼职讲师。曾任职于倡导精神病人权利的公益法律机构。研究领域主要为精神卫生法、残障法律与政策、《联合国残疾人权利公约》。

Cheng Chihwei used to be a special education teacher. He is the co-founder for Taiwan Pride, the annual LGBTQ pride in Taiwan that was first held in 2003 and has become the largest gay pride event in East Asia. He advocates for an inclusive politics and invite the LGBTQ movement to work hand-in-hand with the disability movement in Taiwan. He introduced the sign language interpretation for 2009 Taiwan Pride in order to welcome sexual minorities from the deaf community. Cheng Chihwei also organized social events for LGBTQ with hearing impairment in 2010 that later turned into Taiwan Rainbow Sign Language Program.

Miki Kawabata's research about the history of Medicine and Hygiene in Modern Japan. She is the author of "The Public Bath Movements in Modern Japan" (Hosei University Press, 2016). She was from Graduate School of Core Ethics and Frontier Science,Ritsumeikan University in 2011. She was a JSPS Research Fellow PD and a PD of the Kinugasa Research Organization of Ritsumeikan University, before the present post.
私は医学史・公衆衛生史について研究しています。2016年に、単著『近代日本の公衆浴場運動』(法政大学出版局、2016年)を刊行しました。2011年に立命館大学先端総合学術研究科を終了し、日本学術振興会特別研究員PD、立命館大学衣笠総合研究機構専門研究員などを経て、現在は生存学研究所で研究をすすめています。

Lee Kwan Hyeong is a writer, publisher, instructor, and journalist. Having had schizophrenia since 2003, he has been working as an instructor and journalist about disability issues. A sole witness with psychosocial disabilities who participated in the deliberation of the Committee on Health, Labour and Welfare at the 193rd ordinary session of the Japanese Diet in 2017. Author of “From the Utsunomiya Hospital Scandal in 1984 to the Revision of the Mental Health Act in 1987: Examining the Relationship between the Accepted History and the Original Intention of the Whistle-blower and His Supporters (Core Ethics volume 11 in 2015),” and many other articles.
博士(学術)。2006年から全国「精神病」者集団・運営委員。2017年に第193回通常国会参議院厚生労働委員会において当事者で唯一の参考人を務めた。論文として「宇都宮病院事件から精神衛生法改正までの歴史の再検討――告発者及びその協力者の意図との関係」(Core Ethics 11、2015年)ほか多数。

Chang Heng-hao is a professor from the Department of Sociology, National Taipei University, Taiwan. He received his PhD in Sociology from University of Hawaii, Manoa. He is currently the president of the Taiwan Society for Disability Studies. His research interests include disability rights movement, representation of disabilities, and inclusive education. He currently serves on the editorial board of the Bulletin of Special Education and International Journal of Disability and Social Justice. His current research projects include vernacularization of CRPD in Taiwan and comparative studies on the indigenous disabled people in Australia and Taiwan.
